Terms and Conditions

1. Introduction

These Terms of Use ("Terms") govern your access to and use of the BeatScope mobile application and related services ("BeatScope", "App", "we", "our", "us").

By accessing or using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not use the App.

2. Purpose of the App

BeatScope is a global music-driven social platform that allows users to:

• Collect BeatNotes
• Customize avatars and visual appearance
• Create and participate in events
• Leave traces and interact with a shared interactive map
• Explore real-time music trends
• Access the BeatShop for virtual items, upgrades, and cosmetic features
• View other users' profiles and music activity
• Use Incognito Mode (premium feature) to hide location while using all features
• Create and manage events (requires Pro subscription and Event Tokens)

The App is provided strictly for entertainment purposes.

3. Accounts and Authorization

Users may log in using Spotify or Apple Music.

You are solely responsible for maintaining the confidentiality and security of your account credentials.

Your use of third-party logins must comply with Spotify's and Apple Music's respective terms and policies.

We may suspend or terminate your account at our discretion if we believe you have violated these Terms or applicable law.

4. Age Requirements

You must be at least 13 years old to use the App.

Users under 18 must have valid parental or guardian consent.

By using the App, you represent that you meet these requirements.

5. Data We Collect

We may collect the following categories of personal and technical data (where applicable and with consent):

• Email address and nickname
• Geolocation data (if enabled by the user)
• Phone number
• Profile photo
• Device identifiers and technical data
• Music data retrieved via Spotify/Apple Music SDKs (with explicit user authorization)

Full details are provided in our Privacy Policy, which forms part of these Terms.

6. In-App Currency: BeatNotes

BeatNotes are virtual items with no monetary value.

• They are non-transferable, non-refundable, and cannot be exchanged for real currency
• BeatNotes can be acquired via in-app purchases or through use of the App (e.g., daily login bonuses)
• BeatNotes are used to purchase digital items, backgrounds, borders, and other cosmetic features

Event Tokens are virtual items required for creating events.

• Event Tokens are non-transferable, non-refundable, and cannot be exchanged for real currency
• Event Tokens can be acquired via in-app purchases using BeatNotes
• Monthly Event Tokens may be provided as part of subscription benefits
• Event creation requires both a BeatScope Pro subscription and at least one Event Token
• Event Tokens are consumed when you create an event

7. Subscriptions

We offer monthly and annual subscription plans (BeatScope Pro) providing access to premium features.

All payments are processed via the Apple App Store.

Subscriptions automatically renew unless cancelled at least 24 hours before the current billing period ends.

Cancellation prevents future billing but does not provide refunds for the current period.

Subscriptions do not grant ownership of any digital items.

Refund requests must be submitted through Apple App Store's refund process in accordance with Apple's policies. BeatScope does not process refunds directly.

You may manage your subscription, including cancellation, through your Apple App Store account settings.

8. Premium Features and Limitations

BeatScope Pro subscription provides access to premium features including:

• Unlimited profile views (free users are limited to 15 profile views per day)
• Incognito Mode (ability to hide your location from other users)
• Event creation capabilities
• Priority support

Free users have the following limitations:

• Limited to 15 profile views per day (resets every 24 hours)
• Cannot create events (requires Pro subscription and Event Tokens)
• Cannot use Incognito Mode
• Standard support

Profile view limits are enforced locally on your device and reset automatically every 24 hours.

9. Digital Items and Customization

Digital items (including avatar frames, backgrounds, and visual effects) are licensed, not sold.

Users receive a limited, revocable, non-exclusive, non-transferable license for use within the App only.

Items may be modified, discontinued, or removed at any time without prior notice.

All such items are provided "as is".

10. Map Drawings and User-Generated Content (UGC)

Users are solely responsible for all content they submit or display through the App, including Map Drawings and any other UGC.

Prohibited content includes, without limitation:

• Personal data of third parties (names, phone numbers, addresses, etc.)
• Illegal content, hate speech, threats, or harassment
• Spam, promotional materials, or advertising
• Sexual, violent, extremist, or otherwise harmful content

Users must comply with the GDPR and all applicable local laws.

BeatScope is not liable for user-generated content but reserves the right to remove any content at its sole discretion.

Map Drawings expire automatically after 5 minutes and are permanently deleted from all active systems and backups.

Drawing functionality is subject to an energy system:

• Drawing energy depletes while drawing
• When energy is fully depleted, users must wait for regeneration (currently 90 seconds) before drawing again
• Energy regenerates automatically after the waiting period
• This system is subject to change and may be modified at any time

Technical drawing limitations (line count, length) are implemented to prevent abuse (e.g., posting sensitive data).

Incognito mode hides the user's location from other users while keeping all features functional. Incognito mode is only available to BeatScope Pro subscribers.

11. Events

Event Creation Requirements:

• Creating events requires an active BeatScope Pro subscription
• Each event creation consumes one Event Token
• Users must have at least one Event Token (purchased or monthly allocation) to create an event

Event Participation:

• All users (free and Pro) can view and participate in events
• Event participation is tracked and displayed on user profiles
• Users can participate in multiple events simultaneously

Event Information:

• Events include: name, description, address, location coordinates, date, and time
• Event creators are responsible for the accuracy and legality of event information
• Events may be removed by BeatScope if they violate these Terms or applicable laws

Event Tokens:

• Event Tokens can be purchased through in-app purchases
• Monthly Event Tokens may be provided as part of subscription benefits
• Unused Event Tokens do not expire but are non-refundable
• Event Tokens cannot be transferred between users

12. Restrictions on Use

Users are strictly prohibited from:

• Modifying, reverse-engineering, or attempting to hack the App
• Using bots, automation tools, scripts, or cheats
• Interfering with App servers, APIs, or network operations
• Collecting, harvesting, scraping, or otherwise obtaining data from other users
• Attempting to bypass profile view limits or other usage restrictions
• Creating multiple accounts to circumvent limitations
• Sharing account credentials with others
• Using the App for commercial purposes without authorization
• Impersonating other users or entities

Any violation may result in immediate termination of access.

13. Location Sharing and Privacy

By using BeatScope, you acknowledge that:

• Your location data (GPS coordinates) is shared with other users on the map when you are visible
• Location data is collected and displayed in real-time while the App is active
• Other users can see your approximate location on the interactive map
• Your current music track information may be displayed to other users when you are visible

Incognito Mode (BeatScope Pro feature):

• Hides your location from other users while maintaining all App functionality
• Your location is still collected for App functionality but not displayed to others
• You can enable or disable Incognito Mode at any time (Pro subscribers only)

You can disable location sharing entirely through your device settings, but this will limit App functionality.

14. Termination and Appeals

We may suspend or terminate accounts at our discretion for violations of these Terms or applicable laws.

Grounds for termination include, but are not limited to:

• Violation of these Terms of Use
• Violation of applicable laws or regulations
• Posting prohibited content
• Attempting to circumvent App limitations or restrictions
• Fraudulent activity or abuse of payment systems
• Harassment or harmful conduct toward other users

Users may submit an appeal within 14 days of suspension or termination via the contact information provided.

All decisions by BeatScope on appeals are final.

Upon account termination:

• Your access to the App will be immediately revoked
• Your user-generated content may be removed
• Digital items and virtual currency cannot be transferred or refunded
• Data retention will follow our Privacy Policy

15. SDK Integration (Spotify / Apple Music)

By authenticating via Spotify or Apple Music, you consent to their respective SDKs processing your data, which may include:

• Account details
• Playback activity
• Music preferences and listening history
• Current playing track information (displayed to other users on the map)

Such data may be processed outside the European Union.

You can revoke access to music data at any time through your device settings or by disconnecting the service in the App.

16. Account Deletion

You may request account deletion at any time by contacting us through the provided contact information.

Upon account deletion:

• Your account and profile will be permanently removed
• Your user-generated content (Map Drawings, Events you created) will be deleted in accordance with our data retention policies
• Digital items and virtual currency cannot be recovered
• Some data may be retained for legal or tax compliance purposes as outlined in our Privacy Policy

Account deletion is irreversible. Please ensure you have exported any data you wish to keep before requesting deletion.

17. Liability Disclaimer

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We are not responsible for:

• User-generated content
• Data processed by third-party SDKs
• Device failures, connectivity issues, or interruptions
• Loss, modification, or unavailability of digital items
• Conduct or actions of other users
• Loss of virtual currency or digital items due to account termination or App modifications
• Changes to App features, limitations, or energy systems
• Mock or test user data that may appear in the App

The App may include mock or test user data for demonstration purposes. Such data is clearly marked and does not represent real users.

To the maximum extent permitted by law, our liability is limited.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of Spain, without regard to conflict-of-law principles. Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and BeatScope regarding your use of the App and supersede all prior agreements or understandings related to the App.

19. Changes to the Terms

We may update these Terms from time to time.

Revised Terms become effective when posted within the App or on this page.

Continued use of the App after changes indicates acceptance of the revised Terms.
