1. Introduction

BeatScope ("App", "we", "us") respects intellectual property rights.

Users may generate content including Map Drawings, messages, avatars, events, and musical activity via Spotify / Apple Music SDKs.

This Policy describes how rights holders can report alleged copyright infringement and how BeatScope handles takedown requests in accordance with:

  • EU copyright law and directives, including Spanish law
  • GDPR / data protection requirements
  • DMCA §512 safe harbor principles, for international compliance
  • App Store content policies

2. Reporting Copyright Infringement

If you believe your copyrighted work is being used on BeatScope without authorization, submit a notice to:

Your notice must include:

  • Description of the copyrighted work you claim is infringed.
  • Identification of infringing content within the App (e.g., screenshot, Map Drawing coordinates, username).
  • Your contact information: name, email, and optional address or telephone.
  • A statement that you have a good-faith belief that the use of the material is unauthorized.
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  • Your electronic or physical signature (typed name is sufficient).

Incomplete notices may be rejected.

3. Takedown Procedure

Upon receiving a valid notice:

  • BeatScope reviews the notice for completeness and credibility.
  • If credible, BeatScope may:
    • Remove or disable access to the infringing content
    • Notify the user who posted the content
  • We may forward the notice to the user who posted the content.
  • BeatScope is not responsible for content delivery originating from third-party sources (e.g., Spotify / Apple Music SDKs).

We aim to process takedown requests within 7 days of receipt.

4. Counter-Notice by Users

If your content is removed and you believe it was done in error, you may submit a Counter-Notice to the Copyright Agent:

  • Your identification (name, username, email).
  • Identification of the removed content (screenshot or description).
  • Statement of good-faith belief that content was removed incorrectly.
  • Consent to jurisdiction of courts in Spain for dispute resolution.
  • Your electronic signature.

If a valid Counter-Notice is received, content may be restored unless the original complainant initiates legal proceedings.

5. Repeat Infringers

Users who repeatedly post infringing content or abuse the complaint process may have their accounts suspended or permanently terminated.

BeatScope determines repeat infringement based on severity, frequency, and context.

6. Disclaimer and Liability

BeatScope is a platform for user-generated content. Users are solely responsible for compliance with copyright law.

BeatScope does not monitor or control all user content.

BeatScope disclaims all liability for content posted by users, including Map Drawings, avatars, and Spotify/Apple Music activity.

Removal of content does not entitle users to compensation or refunds.

7. GDPR and Data Handling

Personal data of users involved in complaints will be processed only to handle the copyright claim.

Data will be retained no longer than necessary for this purpose.

Information may be shared with rights holders only to the extent necessary to resolve the claim.

Users' privacy is protected under GDPR and Spanish law.

8. Recommendations for Rights Holders

Removing content from BeatScope does not guarantee permanent removal from external sources (e.g., Spotify / Apple Music).

We recommend contacting the original content publisher for permanent resolution.
